By accessing or using KartBio ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all users, including sellers, businesses, and visitors. We reserve the right to modify these Terms at any time. Continued use after changes constitutes acceptance.

KartBio provides a platform that allows users to create customizable bio link pages with integrated product catalogs and WhatsApp ordering functionality. The service includes:

• Customizable store pages accessible via unique URLs
• Product catalog management
• WhatsApp order integration
• Analytics and page view tracking
• Social media link aggregation

We reserve the right to modify, suspend, or discontinue any feature of the Service at any time.

To use KartBio, you must:

• Be at least 13 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of unauthorized access
• Keep only one active account unless explicitly authorized

You are responsible for all activities under your account. We are not liable for losses due to unauthorized use resulting from your failure to maintain account security.

You agree NOT to:

• Use the Service for illegal purposes or to promote illegal activities
• Upload content that is fraudulent, deceptive, misleading, or defamatory
• Distribute malware, viruses, or malicious code
• Harass, abuse, or harm another person through the Service
• Spam, phish, pyramid schemes, or send unsolicited commercial messages
• Impersonate any person or entity or misrepresent your affiliation
• Use automated systems to access the Service without permission
• Reverse engineer, decompile, or attempt to extract source code
• Circumvent usage limits or access features beyond your plan allowance
• Interfere with or disrupt the Service's servers or networks

We reserve the right to remove content and terminate accounts that violate these rules.

You retain ownership of content you upload (business name, products, images, etc.). However, by uploading content, you grant KartBio a worldwide, non-exclusive, royalty-free license to use, display, and distribute that content solely for providing the Service.

You represent and warrant that:

• You own or have rights to all content you upload
• Your content does not infringe third-party intellectual property rights
• Your content complies with these Terms and applicable laws
• You have obtained necessary consents for any personal data shared

KartBio offers both free and paid subscription plans:

• Free Plan: Limited to 10 products and basic features
• Pro Plan: Enhanced features with monthly billing
• Business Plan: Advanced features with monthly billing

All payments are processed securely through Stripe. Subscription fees are:

• Billed monthly in advance
• Non-refundable except as required by law
• Subject to change with 30 days notice
• Automatically renewed until cancelled

You may cancel your subscription at any time. Access continues until the end of the current billing period. No prorated refunds for partial months.

KartBio and its original content, features, and functionality are owned by KartBio and protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

The following are trademarks of KartBio:

• KartBio name and logo
• All related graphics, icons, and designs
• Website design and layout

You may not use our trademarks without written permission, except to reference KartBio accurately when linking to your store page.

The Service may contain links to third-party websites or services (Instagram, WhatsApp, Stripe, etc.) that are not owned or controlled by KartBio.

We have no control over and assume no responsibility for:

• Third-party content, privacy policies, or practices
• Accuracy, completeness, or legality of third-party materials
• Any damages resulting from interactions with third parties

You acknowledge that KartBio is not liable for any third-party services accessed through the platform.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• RELIABILITY, ACCURACY, OR COMPLETENESS
• UNINTERRUPTED OR ERROR-FREE OPERATION

WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT DEFECTS WILL BE CORRECTED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KARTBIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

• Loss of profits, revenue, or business
• Loss of data or data corruption
• Business interruption
• Personal injury or property damage
• Any indirect or consequential losses

KARTBIO'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE LAST 12 MONTHS, OR $100 IF YOU USED THE FREE PLAN.

THESE LIMITATIONS APPLY REGARDLESS OF LEGAL THEORY (CONTRACT, TORT, STATUTORY, OR OTHERWISE).

You agree to indemnify, defend, and hold harmless KartBio and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your infringement of third-party rights
• Content you upload or share
• Your violation of applicable laws

We may terminate or suspend your account and access to the Service:

• For violation of these Terms
• For fraudulent or illegal activity
• For excessive chargebacks or payment disputes
• If we discontinue the Service
• With or without cause, with or without notice

Upon termination, your right to use the Service ends immediately. Provisions that should survive termination (intellectual property, disclaimers, liability limitations) will remain in effect.

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by:

• Posting updated Terms on this page
• Updating the "Last Updated" date
• Sending email notification for material changes

Changes become effective immediately upon posting. Your continued use after changes constitutes acceptance. If you disagree, you must stop using the Service and may request account deletion.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where KartBio operates, without regard to conflict of law provisions.

Any disputes shall be resolved exclusively in the courts located in that jurisdiction. You agree to submit to the personal jurisdiction of such courts.
